News Release - Shots Fired by Officer

Shortly after 2:00 am this morning, 5/27/12, Officers were in the 1st Blk. of S. Prince Street, observing a large group of people leaving a bar in the area. An individual who standing in the area of King Street and Prince Street got the attention of the officers and directed them to a group of people who were about to fight in the 1st Blk. W. King Street. This in...dividual informed the officers that one of the subjects had a gun and provided a description of the armed suspect. The officers observed two groups of people milling around the area and then observed the suspect that was supposed to be armed. The officers approached this subject and attempted to stop him, but he failed to obey their commands and attempted to flee from the officers on foot.

At this point, the Officers pursued the suspect on foot through a parking lot in the 1st Blk. W. King Street. While pursuing the suspect, the officers observed the suspect reaching into his front waist area. One of the officers observed the suspect holding a handgun in his hand and holding the gun across the front of his body, in a threatening manner, at which point the officer fired one shot at the suspect. The suspect was observed discarding the firearm and then continued to flee on foot. The suspect was ultimately arrested in the 1st Blk. N. Prince Street. He was then taken to an area hospital for treatment for minor head and face injuries and later conveyed to the Police Station, where he is currently in custody. A gun was recovered at the scene. This investigation is on-going, as Detectives are interviewing witnesses and the suspect and as more information is developed, it will be released when it is appropriate to do so.

As is standard protocol with these situations, the name of the Officer involved is not being released at this time. This investigation is being conducted in consultation with the Lancaster County District Attorney’s Office.

As a result, Detective Sergeant Nathan Nickel is charging Jahbree PAYNE with two counts of Violation of the Uniform Firearms Act - Firearms Not To Be Carried Without a License (F-3) and Persons Not to Possess a Firearm (F-2). The charges are being brought before Magisterial District Judge Bruce Roth and the suspect is being held for arraignment.

As always, the District Attorney’s Office will review the case to make the final determination as to the justification of the shots fired by the Officer. As a reminder, anyone accused of a crimes, is presumed innocent until proven guilty in a court of law.
